法官在合同解釋中的地位內容提要：
內容提要: 合同解釋規則本質上屬於裁判規則，構成合同法的重要組成部分。本文論述了合同解釋的基礎和對象、法官在合同解釋中的地位，並結合當今最新立法、司法及法學理論，對合同解釋規則給予了全麵且較為詳細的分析。 The rules of interpratation of contract belong tojudicative rules in nature, which make up one of importantparts of Contract Law. This article has argued the foundationand object of interpretation of contract, and thejudges,position in the course of interpretation,also analysedthe different kinds of rules of interpretation of contract indataits.
　　合同解釋是指闡明合同條款的含義，從而確定當事人在合同中的權利、義務的活動。各國立法均以仲裁機關或法院對合同糾紛的解決為著眼點製定有關合同解釋的規則， 理論界也以同樣的視角探討該問題〔1〕，所以合同解釋的規則也就從性質上具有了裁判規則的特征，它既關涉法官在合同解釋中的地位，又影響到合同糾紛的最終解決，具有重要的理論及實踐意義。
